In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the holder of the e-mail account. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. Sponsor is not responsible for: (i) lost, late, misdirected, damaged, or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (ii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent judging organization, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. The Moorings "Treasure Hunt" Sweepstakes ("Sweepstakes") begins at 12:01 a.m. Eastern Time (ET) on 11/23/09 and ends 11:59 p.m. (ET) on 2/7/10 ("Sweepstakes Entry Period"). Sweepstakes consists of two Monthly Drawings plus one Grand Prize Drawing during the Sweepstakes Entry Period. To qualify for Monthly Drawing #1: Entries must be received between 12:01 a.m. (ET) on 11/23/09 and 11:59 p.m. (ET) on 12/20/09. To qualify for Monthly Drawing #2: Entries must be received between 12:01 a.m. (ET) on 12/21/09 and 11:59 p.m. (ET) on 1/17/10. Entries received for Monthly Drawing #1 will not be included in Monthly Drawing #2. However, all eligible entries received for the entire Sweepstakes Entry Period (11/23/09 – 2/7/10) will be included in the Grand Prize Drawing.
ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States (including the District of Columbia) and Canada (void in the province of Quebec) who are 21 years of age or older at time of entry. Persons who are employees of The Moorings (the "Sponsor"), its respective parent companies, affiliates, subsidiaries, agents and the immediate families (spouse, children, parents and siblings) and/or those living in the same household of such persons at any time before or during this Sweepstakes are not eligible to enter.
HOW TO ENTER: To enter, visit www.moorings.com. Click the Treasure Hunt Sweepstakes section on the right hand side of the page, taking you to clue of the week. Read the clue of the week, which offers hints regarding the key icon's location within The Moorings website. Navigate through the website based upon these hints, and once you have located the key icon, click it to open the entry form. Submitting your information via this form will automatically enter you in the monthly prize drawing for the month in which you are entering, and the grand prize drawing. Weekly clues will change each week during the Sweepstakes Entry Period. Limit: One entry per person per key location identified each week.
All entries become the property of Sponsor and will not be returned or acknowledged. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the holder of the e-mail account. PRIZES & THEIR APPROXIMATE RETAIL VALUES ("ARV"):
One (1) GRAND PRIZE: The Grand Prize winner may select from one of the following British Virgin Island charter options noted herein, specifically for charters departing from The Moorings base in Tortola. Values noted herein are based on high season rates and not over holiday season from Dec. 17 – Jan. 3, 2010 and do not include airfare to/from the point of embarkation. Grand Prize awarded as a gift certificate to the winner featuring the specific details of the charter option (Bareboat, Power, Crewed Stateroom) based on winner's final selection.
BVI Charter Options are as follows: Bareboat Yacht (Mid-level): ARV: $7,000; based on travel from 1/25/2010 – 1/31/2010. Trip includes: 6 nights/7 days on board and provisioning for up to 4 people (including winner). 2) Power Yacht: ARV: $5,700; based upon a charter from 2/15/2010 – 2/21/2010). Trip includes: 6 nights/7 days on board with fuel and provisioning for up to 4 people (including winner). 3) Crewed Yacht – Stateroom Package: ARV: $4,260; based on travel from 3/1/2010 – 6/7/2010. Trip includes: 6 nights/7 days on board accommodations for up to 2 people (including winner). ARV of each trip prize depends on the selected charter option and rates at time of departure. Winner and guest(s) are responsible for travel to the Moorings base in Tortola, BVI. Travel must be complete within 12 months from date the prize is awarded. A parent or legal guardian must accompany a traveling minor. Travel/selected dates subject to availability and certain blackout dates may apply. If the winner of the Grand Prize selects Option 1 or 2, he/she must pass The Moorings certification procedure, or winner can hire a skipper at winner's own expense. Option 3 is all-inclusive i.e., the winner will be supplied with a captain and a chef. Grand Prize winner and guest(s) must travel on dates designated by Sponsor or forfeit all rights to the prize. In the event any of the charter is canceled, the Sponsor shall have no further obligation to the winner other than to provide a substitute prize. Winner and guest(s) must travel together and are solely responsible for all necessary travel preparation and proper documentation prior to travel, such as but not limited to visas, passports, vaccinations and photo identification. Winner and guest(s) must execute and return a Travel & Liability Release ("Travel Release") prior to travel.
MONTHLY PRIZES: Month #1: One prize winner will be awarded a $75 Merchandise Promotional Gift Certificate for Moorings Merchandise online (ARV: $75). Month #2: One prize winner will be awarded a Flip Video Ultra (Model U1120) plus Underwater Case (ARV: $199.98).
Maximum (ARV) of all prizes: $7,274.98. Prize values are in U.S., currency. Gift Certificates are subject to the promotional certificate Terms & Conditions. Prizes are not transferable or redeemable for cash. No prize substitution, except due to unavailability, in which case a prize of equal or greater value will be awarded. All taxes and any other incidental expenses not mentioned herein are the sole responsibility of the winner. Odds of winning depend on the total number of eligible entries received for the applicable Monthly Drawing and Grand Prize Drawing.
WINNER SELECTION: Potential Monthly Drawing winners will be selected by random drawings within 15 days of the end of a Monthly Drawing entry deadline from among all eligible entries received for the applicable Monthly Drawing. All eligible entries received during the Sweepstakes Entry Period will be automatically entered into the Grand Prize Drawing and a winner will be selected on or about 2/8/10 and his or her name will be announced on 2/14/10 at the Miami Boat Show in Miami, Fl. Winning any prize is contingent upon verification by the independent judging organization. Limit: one monthly prize per person. If during any month no entries are received for the Monthly Drawing, that month's prize will be awarded as an additional prize in the following Month Drawing, provided a sufficient number of entries are received for that month. This process will be repeated until all monthly prizes are awarded. If no entries are received for the last monthly drawing, then any remaining prizes will be awarded in the Grand Prize Drawing.
WINNER NOTIFICATION: All random drawings will be conducted under supervision of an independent judging organization whose decisions are final and binding. Each winner will be notified by mail, or phone or email within 7 business days after the drawing. To be declared a winner, all potential winners must be verified and may be required to complete and an affidavit of eligibility and liability/publicity release (where permissible) within 10 days of date specified on notification or an alternate winner will be selected. Prizes will be awarded within 30 days after prize notification or receipt of properly executed affidavit. If an affidavit or prize notification is returned as undeliverable, it will result in disqualification, and the corresponding prize will be awarded to an alternate winner in a separate random drawing from all non-winning eligible entries. Entry & acceptance of prize constitute permission to use a winner's name, prize won, hometown & likeness for promotional purposes without further compensation, except where prohibited by law.
Canadian residents, to win, must first correctly answer, unaided, a time-limited mathematical skill testing question administered by mail.
CONDITIONS OF ENTRY: All federal, state, provincial and local laws apply. Winners responsible for all taxes on prizes. U.S. laws govern all aspects of this sweepstakes. Void where prohibited by law. Entrants must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all such terms and conditions. DISPUTE/CHOICE OF LAW: All dispute and claims arising out of or relating to this Sweepstakes shall be determined according to the laws of the State of New York without regard to its conflict of law principles and all participating entrants consent to the personal jurisdiction of the federal and state courts located in New York County and agree that such courts have exclusive jurisdiction over all such disputes. All causes of action arising out of or in connection with this Sweepstakes shall be resolved individually without resort to any form of class action litigation and any and all claims, judgments and awards shall be limited to actual out of pocket expenses incurred.
